Agreement to the Terms of Use
GENERAL PROVISION
The Patient Safety Movement Foundation (the “PSMF”) owns and operates patientsafetymovement.org and patientsafetysummit.org (each, a “Site”), located on servers in the United States. By visiting and/or using this Site, you agree to these Terms of Use (“Terms of Use” or “Agreement”), as it is amended from time to time. This Agreement contains conditions of use, disclaimers, and other provisions, some of which limit our liability to you. If you do not agree to these Terms of Use or cannot form a legally binding contract, you are not permitted to use this Site.
PSMF SERVICE
Through the Site, the PSMF provides information regarding patient safety and online forums for the discussion of topics related to patient safety. The forum services, whether offered through the Site or any other medium in the future, is only available for Registered Users (defined in the Forum Registration section below) who are eighteen (18) years old or older. We do not allow persons under age 18 to create a user account.
FORUM REGISTRATION
The forums and certain areas of the Site are only available to users who create an account with the PSMF (“Registered Users”). Additionally, Registered Users of the Workgroup Discussion Board must agree to the terms of the conflict of interest form and contributor agreement, and Registered Users of the Shared Learning Network must have completed registration for a Commitment (as defined here). When you create an account through the Site, you may be required provide us with certain information, including, without limitation, (i) your name; (ii) title and organization; (iii) address; (iv) email address; (v) phone number; and (vi) username and password (the “Registration Data”). The PSMF, in its sole discretion, may accept or deny any application to become a Registered User or revoke the right to be a Registered User at any time or for any reason.
Furthermore, you agree to provide accurate, current and complete Registration Data as may be prompted by any registration forms on the Site, and to keep the Registration Data current and complete, including updating such Registration Data immediately upon any change. The Registration Data submitted by you to create your account will be used in accordance with our Privacy Policy. YOU HEREBY REPRESENT AND WARRANT THAT THE REGISTRATION DATA IS ACCURATE AND COMPLETE IN ALL MATERIAL RESPECTS.
SUBMISSIONS & RESTRICTIONS ON USE
You agree that you are responsible for any submissions you make on this Site and that the PSMF merely acts as a passive conduit of the information made available through the Site. By accessing or otherwise using the Site, you acknowledge and assume all risks of harm, loss, or damage related to your use of the Site, and hereby waive all claims and/or causes of action related to your use of the foregoing, including but not limited to any advice obtained through the Site or the discussion forums and any information that you share through the Site. By posting on the Site, you acknowledge that any information that you share through the Site is visible to other users and is not subject to any confidentiality obligations. Neither the PSMF nor its affiliates is responsible for the content provided by any user of the Site and/or the conduct of any user, whether online or offline. You agree that the PSMF shall not be responsible or liable for any claim, injury, loss, or damage of any sort incurred as the result of any such dealings, and you agree to bear all risks associated therewith. You shall not submit unlawful, defamatory, abusive, obscene, or offensive material. You agree to not post or transmit any communication or solicitation attempting to obtain password, account, private user information, or any confidential information (including patient information). You agree to not post any unauthorized advertisement or spam other users. You agree that you will not submit anything to the Site that will or may violate any rights of a third party, including but not limited to copyright, trademark, and/or privacy rights. Please report any violations of these Terms of Use to the PSMF at [email protected].
You agree that you shall not place false or misleading information on this Site or upload any viruses, Trojan horses, worms, time bombs, or other computer programs that may interfere with the proper operation of this Site.
THIRD PARTY LINKS
The Site and Registered Users may provide links and references to websites of others, including advertisements and promotions from third parties. We may, from time to time, at our sole discretion, add or remove links to other websites. These links are provided solely as a convenience to you, and access to any such websites is at your own risk. Your business dealings, communications with or participations in promotions with advertisers (other than the Site) and any terms, conditions, warranties or representations associated with such dealings are solely between you and such third parties. We will not, under any circumstances, be responsible for the information displayed on such websites, their practices, for your use of or inability to use such websites or transmissions received from such websites. By accessing the Site or using the Service, you expressly relieve us from any and all liability arising from your use of any third-party website.
CONSENT TO ELECTRONIC COMMUNICATIONS
By registering as a Registered User, you acknowledge that the PSMF may need to send you communication or data via email or other method regarding the Site, including, but not limited to, notices about your use of the Site, updates to the Site, and new activity on designated forums and forum posts. By using the Site, you consent to the receipt of electronic messages from us, including notices of forum activity and forum posts. Should you elect to opt out of the receipt of electronic messages, you may do so by following the instructions provided in such message. All such communications sent by the PSMF are opt-in only and include instructions on how to unsubscribe from such communications.
COPYRIGHT & TRADEMARK
Unless expressly noted otherwise, all materials on this Site are protected by copyright, trademarks, service marks, and/or other intellectual property rights held by the PSMF, its initiatives, affiliates, or other parties that have allowed the PSMF to use their materials. All rights not expressly granted are reserved.

The PSMF attempts to respond to claims of copyright infringement in a timely manner. If you believe this Site (or any material contained on this Site) is infringing your copyright, please send the following information to [email protected]:

- A description of the material that you believe may be violating your copyright
- Your address, telephone number, and e-mail address

Links on this Site may connect you to other websites that are not related to the PSMF or under its control. DONATIONS
All donations made using this Site must be made in compliance with federal, state, and local laws relating to charitable contributions, including but not limited to the U.S. Patriot Act and the IRS Tax Code, as they may be amended from time to time.
PRIVACY POLICY
The PSMF is committed to helping you understand how information collected from your computer or submitted by you to the Site is used. This information is contained in our Privacy Policy, which is part of these Terms of Use and is incorporated fully herein.
MODIFICATION
The PSMF may and will modify any of these Terms of Use, including our Privacy Policy, at any time, for any reason, by making changes to the Terms and/or these postings. Your continued use of this Site, after such modifications, constitutes acceptance of such modifications.
DISCLAIMER OF WARRANTIES & LIABILITIES
The PSMF does not guarantee that the functions and contents contained in or on the Site will be without errors, that this Site will be free of viruses, or that any Site defects will be corrected, even if the PSMF is aware of them.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the PSMF, its affiliates, initiatives, members of its Boards, employees, and agents from any and all losses, damages, liabilities, and costs of every nature incurred by any of them in connection with any claim, damage, or loss related to your unlawful, unauthorized, and /or inappropriate use of this Site or any materials contained on this Site.
JURISDICTION
Any dispute rising from these Terms of Use, including our Privacy Policy, shall be construed and enforced in accordance with the laws of the State of California without regard to the principles of conflicts of law. You acknowledge and agree that the courts of the State of California shall have exclusive jurisdiction over any and all such disputes, that you shall submit to that jurisdiction and those courts, and that you expressly waive any and all rights you may have, or that may hereafter arise, to contest the propriety of such choice of jurisdiction and venue, including issues of forum non conveniens.
